MIAMI MOVILIDAD S.L, hereinafter MIAMI, in accordance with current regulations on the protection of personal data, informs you that the personal data collected through paper or computer forms is included in specific automated files belonging to users of MIAMI’s services.
The purpose of the collection and automated processing of personal data is to maintain the commercial relationship and to carry out information, training, advisory, and other activities specific to MIAMI.
This data will not be transferred to any entity outside MIAMI, with the sole exception of legal obligation or mandate.
MIAMI takes the necessary measures to ensure the security, integrity, and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
Users may at any time exercise their rights of access, opposition, rectification, and cancellation recognized in the aforementioned Regulation (EU). Users may exercise these rights by sending an email to: info@miamicarhire.com or by writing to the postal address: Calle Emilio Hurtado, 10. 29004 Málaga.

The user declares that all the information provided by him/her is true and correct, and undertakes to keep it up to date, communicating any changes to MIAMI.

Purpose of personal data processing:
For what purpose will we process your personal data?
1. In the event of contracting the services offered, to maintain the contractual relationship, as well as for the management, administration, information, provision, and improvement of the service.
2. To send information requested through the forms provided in digital or physical format.
3. To send newsletters, as well as commercial communications about promotions and/or advertising from our company and/or the sector. In this case, there is a separate box on the forms and contracts for the user to voluntarily fill in to receive such information.
We remind you that you can object to the sending of commercial communications by any means and at any time by sending an email to the address indicated above.

How long is the personal data collected kept?
The personal data provided will be kept for as long as the commercial relationship is maintained and no request for its deletion is made. Subsequently, it will be kept for the legally required periods (except, in both cases, if the processing was based on the User’s consent and the User revoked it, in which case it will be kept until such revocation is received).
Therefore, we can guarantee that your data will not be kept longer than necessary for the purposes described above, without prejudice to the storage that may be necessary for the formulation, exercise, or defense of potential claims and/or whenever permitted by applicable law.

Legitimacy
The processing of your data is carried out on the following legal bases that legitimize it:
1. The request for information and/or the contracting of MIAMI’s services, the terms and conditions of which will be made available to you in any case prior to any eventual contracting.
2. Your free, specific, informed, and unequivocal consent, insofar as we inform you by making this privacy policy available to you, which, after reading it, if you agree, you can accept by means of a statement or a clear affirmative action, such as checking a box provided for that purpose.

If you do not provide us with your data, or if you provide us with incorrect or incomplete data, we will not be able to respond to your request, making it impossible to provide you with the requested information or to contract the services.

Recipients
The data will not be communicated to any third party outside MIAMI, except where legally required.
In order to provide the best possible service, MIAMI may require other third parties to access the User’s personal data as data processors.
In addition to the above, MIAMI may transfer or communicate personal data in order to comply with its obligations to the Public Administrations in cases where this is required in accordance with the legislation in force at any given time and, where applicable, to other bodies such as the State Security Forces and Corps and the Judicial Bodies.

User rights
MIAMI informs the User of their right to exercise their rights of access, rectification, opposition, erasure, portability, and restriction of processing, as well as to refuse the automated processing of personal data collected by MIAMI.

These rights may be exercised free of charge by the User, and where applicable, by their representative, by sending a written and signed request to the following address: Calle Montesquieu, 4. 1º A. 29010 Málaga. This request must include the following information: the User’s first and last names, address for notification purposes, photocopy of their National Identity Document or Passport, and a specific request. We also inform you that the User may also exercise the aforementioned rights by sending an email to: info@miamicarhire.com.
In addition to the above rights, the User shall have the right to withdraw the consent given at any time by means of the procedure described above, without such withdrawal of consent affecting the lawfulness of the processing prior to the withdrawal. MIAMI may continue to process the User’s data to the extent permitted by applicable law.
MIAMI reminds the User that they have the right to lodge a complaint with the relevant supervisory authority.

Security measures implemented
MIAMI undertakes to comply with its obligation of secrecy regarding personal data and its duty to store it, and will take the necessary measures to prevent its alteration, loss, unauthorized processing, or access, in accordance with the provisions of applicable regulations.

MIAMI has implemented the necessary technical and organizational security measures to guarantee the security of your personal data and prevent its alteration, loss, and unauthorized processing and/or access, taking into account the state of technology, the nature of the data stored, and the risks to which it is exposed, whether from human action or from the physical or natural environment, in accordance with the provisions of applicable regulations.
MIAMI is concerned about privacy and, in order to reinforce the confidentiality and integrity of the information in its organization, continuously monitors, controls, and evaluates its processes to ensure respect for privacy and information security, in accordance with international standards.

Protection of hosted information
MIAMI makes backup copies of the content hosted on its servers, but is not responsible for the accidental loss or deletion of data by users. Similarly, it does not guarantee the total replacement of data deleted by users, as such data may have been deleted and/or modified during the period of time since the last backup.

The services offered, except for specific backup services, do not include the replacement of content stored in backups made by MIAMI when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to the user’s prior acceptance.
The replacement of deleted data is only included in the price of the service when the loss of content is due to causes attributable to MIAMI.

Commercial communications
In accordance with the LSSI, MIAMI will not send advertising or promotional communications by email or other equivalent electronic means of communication that have not been previously requested or expressly authorized by the recipients thereof.
In the case of users with whom there is a prior contractual relationship, MIAMI will be authorized to send commercial communications regarding products or services that are similar to those that were initially contracted with the customer.
In any case, the user, after proving their identity, may request that no further commercial information be sent to them through the channels indicated above.
